Land Acquisition

Land Acquisition is the activity of providing land by providing appropriate and fair compensation. This definition is in the context of land acquisition for public purposes. There are 18 types of public interest which have been explained in Law No.2/2012 and with the issuance of UUCK No. 11/2020 becomes 24 because there are additional 6 types of public interest.
If land that was initially not available for development becomes available or becomes available through notification of appropriate and fair compensation, then the procedures stipulated in the land procurement regulations must be followed. In essence, there are 4 stages that must be passed, namely (i) the planning stage by the agency that needs the land, then (ii) the preparation stage by the preparation team formed by the governor or if delegated to the regent/mayor, the preparation team is formed by the regent/mayor.
After receiving the development location determination letter, the agency submits (iii) the land acquisition implementation stage to the ATR/BPN Regional Office. Later, the ATR/BPN Regional Office will form a land procurement implementation team assisted by Task Force A and Task Force B to identify and inventory who is the owner, authority, user/user of the land and what assets are affected. The land procurement implementation team can also be the Regency/City ATR/BPN Office team if land acquisition implementation is assigned to the Regency/City Kantah.
Furthermore, the results of the identification and inventory of Task Force A and Task Force B, which are outlined in the nominative list, assess the land and assets. by the land assessment team, the results are to determine the compensation that is expected to be appropriate and fair.
After the entire land acquisition process has entered (iv) the results delivery stage, namely all documentation of the land acquisition process is handed over by the land procurement implementer to the agency that needs the land . Furthermore, the land that has been obtained or is available is certified by the agency that requires the land to build infrastructure or be used/utilized according to its main duties and functions.
